Richmond circuit Court (in vacation), September 29th, 1864. --Elias Rollow, who claims exemption from active service as being over forty-five years of age, came before court to-day on a writ of habeas corpus. This case has been pending for some days, and a large number of witnesses have been examined on the question of the petitioner's age. The Judge decided without argument from counsel that the testimony did not justify the court in releasing him, and therefore remanded him to the custody of Major Peyton. Mr. Myers appeared as counsel for petitioner, and Mr. Neeson for the Government.
