Commonwealth vs. David A. Keith. --This case came up before the Mayor yesterday. Keith was charged with the killing of John Griffin — a fact which he admitted, and pleading in justification of the homicide that it was committed by him while aiding a civil officer to arrest the deceased, and not until after the deceased had fired at him (Keith) four times with a pistol. His Honor examined only the witnesses whose testimony was supposed to be material to the issue. The shooting appeared to have been done in self-defence, and Keith was accordingly discharged from custody. The accused has as long a head as had Sir Walter Scott, and presents rather a remarkable appearance. He evidently thought he had done nothing more than his duty in killing Griffin.
It may be mentioned, as indicating in some respect the character of John Griffin, the man who was shot the other day by Sergeant Keith, that the pistol found on his person bore the number, and precisely filled the description, of one which had been described to the police previously as having been stolen from a soldier.
