C. S. District Court. --In Judge Halyburton's Court on Saturday morning the following business was transacted: William Newell, for representing that he is illegally detained in the custody of J. J. Conway, Capt. Co. A, 1st regiment engineer troops, stationed near Camp Lee, who asks for a discharge on the ground that he was over the age of forty five years at the time he was arrested as a conscript and assigned to said company, the Court, after fully considering the petition, arguments of counsel, and evidence adduced, ordered that the said Newell be discharged from the service. It appeared from the evidence that Newell was arrested in Raleigh. N. C., one hundred and twenty miles from his home, whence he was sent to Camp Holmes in said State, and afterwards hastily carried to Virginia, without being allowed the least opportunity of proving his age, though his appearance furnished prima facis evidence that he was over the age specified and required in the conscriptio
