was commanded to summon and did summon jurors not properly qualified to act as such; which motion was overruled, and the Court
proceeded to sentence the prisoner to nine years confinement in the penitentiary, in conformity with the verdict.
The execution of sentence was suspended until the 1st of February, 1862, to give an opportunity to take the case up to the Court of Appeals.
