, charged with feloniously assaulting and beating M. W. Swain
with a stick of wood, was before the Mayor
yesterday for a further hearing.
Two witnesses, strangers to all parties, who saw the occurrence, testified that the prisoner was badly treated, and that Mr. Swain
first seized a stick of wood to strike prisoner, when a scuffle ensued, prisoner getting possession of the wood and giving Swain
a blow that came nigh killing him. With these facts the Mayor
discharged Mr. Shepperson
, but required his son, who first had a difficulty with Mr. Swain
's son, to give security to appear this morning.
