<milestone unit="sentence" n="3573" />At the time of <persName n="Smith,,Kirby,,," id="n0035.0035.00413.04870" reg="default:Smith,Kirby,,," authname="smith,kirby"><foreName full="yes">Kirby</foreName> <surname full="yes">Smith</surname></persName>'s surrender the <rs>National Government</rs> had formulated no plan with regard to these or the other States lately in rebellion, though a provisional Government had been set up in <placeName reg="Louisiana" key="tgn,7007256" authname="tgn,7007256">Louisiana</placeName> as early as <dateStruct value="1864--" full="yes" authname="1864"><year reg="1864" full="yes">1864</year></dateStruct>.

<p>

<milestone unit="sentence" n="3576" />The convening of this body gave rise to much dissatisfaction among the people of <placeName reg="Texas" key="tgn,7007826" authname="tgn,7007826">Texas</placeName>.

<milestone unit="sentence" n="3577" />They had assumed that affairs were to go on as of old, and that the reintegration of the <rs>State</rs> was to take place under the administration of <persName n="Murray,Governor,,,," id="n0035.0035.00413.04876" reg="nearbymention:Murray,Pendleton,,," authname="murray,pendleton"><roleName n="Governor" full="yes">Governor</roleName> <surname full="yes">Murray</surname></persName>, who, meanwhile, had taken it upon himself, together with the <name>Legislature</name>, to authorize the election of <pb id="p.414" n="414" /> delegates to a <orgName n="State Convention" type="convention">State Convention</orgName>, without restriction as to who should be entitled to vote.

<milestone unit="sentence" n="3578" />Thus encouraged, the element but lately in armed rebellion was now fully bent on restoring the <rs>State</rs> to the <rs>Union</rs> without any intervention whatever of the <rs>Federal Government</rs>; but the advent of <persName n="Hamilton,,,,," id="n0035.0035.00414.04877" reg="nearbymention:Hamilton,A.,J.,," authname="hamilton,a.,j."><surname full="yes">Hamilton</surname></persName> put an end to such illusions, since his proclamation promptly disfranchised the element in question, whose consequent disappointment and chagrin were so great as to render this factor of the community almost uncontrollable.

<milestone unit="sentence" n="3579" />The <rs type="role" reg="provisional-Governor">provisional Governor</rs> at once rescinded the edict of <persName n="Murray,Governor,,,," id="n0035.0035.00414.04878" reg="nearbymention:Murray,Pendleton,,," authname="murray,pendleton"><roleName n="Governor" full="yes">Governor</roleName> <surname full="yes">Murray</surname></persName>, prohibited the assembling of his convention, and shortly after called <num value="1">one</num> himself, the delegates to which were to be chosen by voters who could take the amnesty oath.

<milestone unit="sentence" n="3580" />The proclamation convening this assemblage also announced the policy that would be pursued in governing the <rs>State</rs> until its affairs were satisfactorily reorganized, defined in brief the course to be followed by the <name>Judiciary</name>, and provided for the appointment, by the <rs>Governor</rs>, of county officials to succeed those known to be disloyal.

<milestone unit="sentence" n="3581" />As this action of <persName n="Hamilton,,,,," id="n0035.0035.00414.04879" reg="nearbymention:Hamilton,A.,J.,," authname="hamilton,a.,j."><surname full="yes">Hamilton</surname></persName>'s disfranchised all who could not take the amnesty oath, and of course deprived them of the offices, it met at once with pronounced and serious opposition, and he quickly realized that he had on his hands an arduous task to protect the colored people, particularly as in the transition state of society just after the close of the war there prevailed much lawlessness, which vented itself chiefly on the freedmen.

<milestone unit="sentence" n="3582" />It was greatly feared that political rights were to be given those so recently in servitude, and as it was generally believed that such enfranchisement would precipitate a race war unless the freedmen were overawed and kept in a state of subjection, acts of intimidation were soon reported from all parts of the <rs>State</rs>. </p>

<milestone unit="sentence" n="3583" /><persName n="Hamilton,,,,," id="n0035.0035.00414.04880" reg="nearbymention:Hamilton,A.,J.,," authname="hamilton,a.,j."><surname full="yes">Hamilton</surname></persName>, an able, determined, and fearless man, tried hard to curb this terrorism, but public opinion being strong against him, he could accomplish little without military aid. As department commander, I was required, whenever called upon, to assist his government, and as these requisitions for help became necessarily very frequent, the result was that shortly after he assumed his duties, detachments of troops were stationed in nearly every county of the <rs>State</rs>.

<milestone unit="sentence" n="3584" />By such disposition of my forces fairly good order was maintained under the administration of <persName n="Hamilton,,,,," id="n0035.0035.00414.04881" reg="nearbymention:Hamilton,A.,J.,," authname="hamilton,a.,j."><surname full="yes">Hamilton</surname></persName>, and all went well till the inauguration of <persName n="Throckmorton,,J.,W.,," id="n0035.0035.00414.04882" reg="default:Throckmorton,J.,W.,," authname="throckmorton,j.,w."><foreName full="yes">J.</foreName> <foreName full="yes">W.</foreName> <surname full="yes">Throckmorton</surname></persName>, who, elected Governor in pursuance of an authorization granted by the convention which <persName n="Hamilton,,,,," id="n0035.0035.00414.04883" reg="nearbymention:Hamilton,A.,J.,," authname="hamilton,a.,j."><surname full="yes">Hamilton</surname></persName> had called together, assumed the duties of the office <dateStruct value="1866-08-09" full="yes" authname="1866-08-09"><month reg="08" full="yes">August</month> <day reg="9" full="yes">9</day>, <year reg="1866" full="yes">1866</year></dateStruct>. </p> 
<p>

<milestone unit="sentence" n="3585" /><num value="1">One</num> of <persName n="Throckmorton,Governor,,,," id="n0035.0035.00414.04884" reg="nearbymention:Throckmorton,J.,W.,," authname="throckmorton,j.,w."><roleName n="Governor" full="yes">Governor</roleName> <surname full="yes">Throckmorton</surname></persName>'s <num value="1" type="ordinal">first</num> acts was to ask the withdrawal or non-interference of the military.

<milestone unit="sentence" n="3586" />This was not all granted, but under his ingenious persuasion <persName n="Johnson,President,,,," id="n0035.0035.00414.04885" reg="nearbymention:Johnson,Andrew,,," authname="johnson,andrew"><roleName n="President" full="yes">President</roleName> <surname full="yes">Johnson</surname></persName>, on the <dateStruct value="-08-13" full="yes" authname="--08-13"><day reg="13" full="yes">13th</day> of <month reg="08" full="yes">August</month></dateStruct>, <pb id="p.415" n="415" /> <dateStruct value="1866--" full="yes" authname="1866"><year reg="1866" full="yes">1866</year></dateStruct>, directed that the new State officials be entrusted with the unhampered control of civil affairs, and this was more than enough to revive the bulldozing methods that had characterized the beginning of <persName n="Hamilton,,,,," id="n0035.0035.00415.04886" reg="nearbymention:Hamilton,A.,J.,," authname="hamilton,a.,j."><surname full="yes">Hamilton</surname></persName>'s administration.

<milestone unit="sentence" n="3587" />Oppressive legislation in the shape of certain apprentice and vagrant laws quickly followed, developing a policy of gross injustice toward the colored people on the part of the courts, and a reign of lawlessness and disorder ensued which, throughout the remote districts of the <rs>State</rs> at least, continued till Congress, by what are known as the <rs>Reconstruction Acts</rs>, took into its own hands the rehabilitation of the seceded States. </p> 
<p>

<milestone unit="sentence" n="3588" />In the <placeName reg="Louisiana" key="tgn,7007256" authname="tgn,7007256">State of Louisiana</placeName> a provisional government, chosen by the loyal element, had been put in operation, as already mentioned, as early as <dateStruct value="1864--" full="yes" authname="1864"><year reg="1864" full="yes">1864</year></dateStruct>.

<milestone unit="sentence" n="3589" />This was effected under encouragement given by <persName n="Lincoln,President,,,," id="n0035.0035.00415.04887" reg="mostcommon:Lincoln,Abraham,,,:2" authname="lincoln,abraham"><roleName n="President" full="yes">President</roleName> <surname full="yes">Lincoln</surname></persName>, through the medium of a <orgName n="Constitutional Convention" type="convention">Constitutional convention</orgName>, which met at New Orleans in <dateStruct value="1864-04-" full="yes" authname="1864-04"><month reg="04" full="yes">April</month>, <year reg="1864" full="yes">1864</year></dateStruct>, and adjourned in <dateStruct value="-07-" full="yes" authname="--07"><month reg="07" full="yes">July</month></dateStruct>.

<milestone unit="sentence" n="3590" />The constitution then agreed upon was submitted to the people, and in <dateStruct value="1864-09-" full="yes" authname="1864-09"><month reg="09" full="yes">September</month>, <year reg="1864" full="yes">1864</year></dateStruct>, was ratified by a vote of the few loyal residents of the <rs>State</rs>. </p> 
<p>

<milestone unit="sentence" n="3591" />The government provided under this constitution being looked upon as provisional merely, was never recognized by Congress, and in <dateStruct value="1865--" full="yes" authname="1865"><year reg="1865" full="yes">1865</year></dateStruct> the returned Confederates, restored to citizenship by the <rs>President</rs>'s amnesty proclamation, soon got control of almost all the <rs>State</rs>.

<milestone unit="sentence" n="3592" />The Legislature was in their hands, as well as most of the <rs>State</rs> and municipal offices; so, when the <rs>President</rs>, on the <dateStruct value="1866-08-20" full="yes" authname="1866-08-20"><day reg="20" full="yes">20th</day> of <month reg="08" full="yes">August</month>, <year full="yes">1866</year>,</dateStruct> by proclamation, extended his previous instructions regarding civil affairs in <placeName reg="Texas" key="tgn,7007826" authname="tgn,7007826">Texas</placeName> so as to have them apply to all the seceded States, there at once began in <placeName key="tgn,7007256" n="1.000 24" reg="louisiana" authname="tgn,7007256">Louisiana</placeName> a system of discriminative legislation directed against the freedmen, that led to flagrant wrongs in the enforcement of labor contracts, and in the remote parishes to numbers of outrages and murders. </p> 
<p>

<milestone unit="sentence" n="3593" />To remedy this deplorable condition of things, it was proposed, by those who had established the government of <dateStruct value="1864--" full="yes" authname="1864"><year reg="1864" full="yes">1864</year></dateStruct>, to remodel the constitution of the <rs>State</rs>; and they sought to do this by reassembling the convention, that body before its adjournment having provided for reconvening under certain conditions, in obedience to the call of its president.

<milestone unit="sentence" n="3594" />Therefore, early in the summer of <dateStruct value="1866--" full="yes" authname="1866"><year reg="1866" full="yes">1866</year></dateStruct>, many members of this convention met in conference at New Orleans, and decided that a necessity existed for reconvening the delegates, and a proclamation was issued accordingly by <persName n="Howell,,B.,K.,," id="n0035.0035.00415.04888" reg="default:Howell,B.,K.,," authname="howell,b.,k."><foreName full="yes">B.</foreName> <foreName full="yes">K.</foreName> <surname full="yes">Howell</surname></persName>, <hi rend="italics"><rs type="role2">President</rs> pro tempore.</hi> </p> 
<p>

<milestone unit="sentence" n="3595" /><persName n="Monroe,Mayor,John,T.,," id="n0035.0035.00415.04889" reg="default:Monroe,John,T.,," authname="monroe,john,t."><roleName n="Mayor" full="yes">Mayor</roleName> <foreName full="yes">John</foreName> <foreName full="yes">T.</foreName> <surname full="yes">Monroe</surname></persName> and the other officials of New Orleans looked upon this proposed action as revolutionary, and by the time the convention assembled (<dateStruct value="-07-30" full="yes" authname="--07-30"><month reg="07" full="yes">July</month> <day reg="30" full="yes">30</day></dateStruct>), such bitterness of feeling prevailed that efforts were made by the mayor and city police to suppress the meeting.

<milestone unit="sentence" n="3597" />I happened to be absent from the city at the time, returning from <placeName reg="Texas" key="tgn,7007826" authname="tgn,7007826">Texas</placeName>, where I had been called by affairs on the <rs type="place">Rio Grande</rs>.

<milestone unit="sentence" n="3598" />On my way up from the mouth of the <placeName key="tgn,7022231" n="1.000 1584" reg="mississippi river" authname="tgn,7022231">Mississippi</placeName> I was met on the night of <dateStruct value="-07-30" full="yes" authname="--07-30"><month reg="07" full="yes">July</month> <day reg="30" full="yes">30</day></dateStruct> by <num value="1">one</num> of my staff, who reported what had occurred, giving the details of the massacre — no milder term is fitting-and informing me that, to prevent further slaughter, <persName n="Baird,General,,,," id="n0035.0035.00416.04890" reg="mostcommon:Baird,nomatch:0" authname="baird"><roleName n="General" full="yes">General</roleName> <surname full="yes">Baird</surname></persName>, the senior military officer present, had assumed control of the municipal government.

<milestone unit="sentence" n="3603" />The leaders were political agitators and revolutionary men, and the action of the convention was liable to produce breaches of the public peace.

<milestone unit="sentence" n="3604" />I had made up my mind to arrest the head men, if the proceedings of the convention were calculated to disturb the tranquility of the <name>Department</name>; but I had no cause for action until they committed the overt act. In the meantime official duty called me to <placeName reg="Texas" key="tgn,7007826" authname="tgn,7007826">Texas</placeName>, and the mayor of the city, during my absence, suppressed the convention by the use of the police force, and in so doing attacked the members of the convention, and a party of <num value="200">two hundred</num> negroes, with firearms, clubs, and knives, in a manner so unnecessary and atrocious as to compel me to say that it was murder.

<milestone unit="sentence" n="3605" />About <num value="40">forty</num> whites and blacks were thus killed, and about <measure n="160" type="wounded">one hundred and sixty wounded</measure>. Everything is now quiet, but I deem it best to maintain a military supremacy in the city for a few days, until the affair is fully investigated.

<milestone unit="sentence" n="3606" />I believe the sentiment of the general community is great regret at this unnecessary cruelty, and that the police could have made any arrest they saw fit without sacrificing lives. </p>

<milestone unit="sentence" n="3620" />The speech of <persName n="Dostie,,,,," id="n0035.0035.00417.04902" reg="mostcommon:Dostie,nomatch:0" authname="dostie"><surname full="yes">Dostie</surname></persName> was intemperate in language and sentiment.

<milestone unit="sentence" n="3621" />The speeches of the others, so far as I can learn, were characterized by moderation.

<milestone unit="sentence" n="3622" />I have not given you the words of <persName n="Dostie,,,,," id="n0035.0035.00417.04903" reg="mostcommon:Dostie,nomatch:0" authname="dostie"><surname full="yes">Dostie</surname></persName>'s <pb id="p.418" n="418" /> speech, as the version published was denied; but from what I have learned of the man, I believe they were intemperate. </p> 
<p>

<milestone unit="sentence" n="3623" />The convention assembled at <num value="12">twelve</num> (<num value="12">12</num>) Pm. on the <num value="30" type="ordinal">thirtieth</num> (<num value="30">30</num>), the timid members absenting themselves because the tone of the general public was ominous of trouble.

<milestone unit="sentence" n="3624" />I think there were; about <num value="26">twenty-six</num> (<num value="26">26</num>) members present.

<milestone unit="sentence" n="3625" />In front of the <orgName n="Mechanics Institute" type="institute">Mechanics Institute</orgName>, where the meeting was held, there were assembled some colored men, women, and children, perhaps <num value="18">eighteen</num> (<num value="18">18</num>) or <num value="20">twenty</num> (<num value="20">20</num>), and in the <rs type="place">Institute</rs> a number of colored men, probably <num value="150">one hundred and fifty</num> (<num value="150">150</num>). Among those outside and inside there might have been a pistol in the possession of every <num value="10" type="ordinal">tenth</num> (<num value="10">10</num>) man. </p> 
<p>

<milestone unit="sentence" n="3626" />About <num value="1">one</num> (<num value="1">1</num>) P. M. a procession of say from <num value="60">sixty</num> (<num value="60">60</num>) to <num value="130">one hundred and thirty</num> (<num value="130">130</num>) colored men marched up <address><street n="Burgundy Street">Burgundy Street</street></address> and across <address><street n="Canal Street">Canal Street</street></address> toward the convention, carrying an American flag.

<milestone unit="sentence" n="3627" />These men had about <num value="1">one</num> pistol to every <num value="10">ten</num> men, and canes and clubs in addition.

<milestone unit="sentence" n="3628" />While crossing <address><street n="Canal Street">Canal Street</street></address> a row occurred.

<milestone unit="sentence" n="3629" />There were many spectators on the street, and their manner and tone toward the procession unfriendly.

<milestone unit="sentence" n="3630" />A shot was fired, by whom I am not able to state, but believe it to have been by a policeman, or some colored man in the procession.

<milestone unit="sentence" n="3631" />This led to other shots and a rush after the procession.

<milestone unit="sentence" n="3632" />On arrival at the front of the <rs type="place">Institute</rs> there was some throwing of brickbats by both sides.

<milestone unit="sentence" n="3633" />The police, who had been held well in hand, were vigorously marched to the scene of disorder.

<milestone unit="sentence" n="3634" />The procession entered the <rs type="place">Institute</rs> with the flag, about <num value="6">six</num> (<num value="6">6</num>) or <num value="8">eight</num> (<num value="8">8</num>) remaining outside.

<milestone unit="sentence" n="3635" />A row occurred between a policeman and <num value="1">one</num> of these colored men, and a shot was again fired by <num value="1">one</num> of the parties, which led to an indiscriminate fire on the building through the windows by the policemen.

<milestone unit="sentence" n="3636" />This had been going on for a short time, when a white flag was displayed from the windows of the <rs type="place">Institute</rs>, whereupon the firing ceased, and the police rushed into the building. </p> 
<p>

<milestone unit="sentence" n="3637" />From the testimony of wounded men, and others who were inside the building, the policemen opened an indiscriminate fire upon the audience until they had emptied their revolvers, when they retired, and those inside barricaded the doors.

<milestone unit="sentence" n="3638" />The door was broken in, and the firing again commenced, when many of the <rs type="color">colored</rs> and <rs type="color">white</rs> people either escaped throughout the door or were passed out by the policemen inside; but as they came out the policemen who formed the circle nearest the building fired upon them, and they were again fired upon by the citizens that formed the outer circle.

<milestone unit="sentence" n="3639" />Many of those wounded and taken prisoners, and others who were prisoners and not wounded, were fired upon by their captors and by citizens.

<milestone unit="sentence" n="3640" />The wounded were stabbed while lying on the ground, and their heads beaten with brickbats.

<milestone unit="sentence" n="3641" />In the yard of the building, whither some of the colored men had escaped and partially secreted themselves, they were fired upon and killed or wounded by policemen.

<milestone unit="sentence" n="3642" />Some were killed and wounded several squares from the scene.

<milestone unit="sentence" n="3643" />Members of the convention were wounded by the police while in their hands as prisoners — some of them mortally. </p> 
<p>

<milestone unit="sentence" n="3644" />The immediate cause of this terrible affair was the assemblage of this Convention; the remote cause was the bitter and antagonistic feeling which has been growing in this community since the advent of the present <rs>Mayor</rs>, who, in the <pb id="p.419" n="419" /> organization of his police force, selected many desperate men, and some of them known murderers.

<milestone unit="sentence" n="3645" />People of clear views were overawed by want of confidence in the <rs>Mayor</rs>, and fear of the thugs, many of which he had selected for his police force.

<milestone unit="sentence" n="3646" />I have frequently been spoken to by prominent citizens on this subject, and have heard them express fear, and want of confidence in <persName n="Monroe,Mayor,,,," id="n0035.0035.00419.04904" reg="nearbymention:Monroe,John,T.,," authname="monroe,john,t."><roleName n="Mayor" full="yes">Mayor</roleName> <surname full="yes">Monroe</surname></persName>.

<milestone unit="sentence" n="3647" />Ever since the intimation of this last convention movement I must condemn the course of several of the city papers for supporting, by their articles, the bitter feeling of bad men. As to the merciless manner in which the convention was broken up, I feel obliged to confess strong repugnance. </p> 
<p>

<milestone unit="sentence" n="3648" />It is useless to disguise the hostility that exists on the part of a great many here toward Northern men, and this unfortunate affair has so precipitated matters that there is now a test of what shall be the status of Northern men-whether they can live here without being in constant dread or not, whether they can be protected in life and property, and have justice in the courts.

<milestone unit="sentence" n="3649" />If this matter is permitted to pass over without a thorough and determined prosecution of those engaged in it, we may look out for frequent scenes of the same kind, not only here, but in other places.

<milestone unit="sentence" n="3650" />No steps have as yet been taken by the civil authorities to arrest citizens who were engaged in this massacre, or policemen who perpetrated such cruelties.

<milestone unit="sentence" n="3651" />The members of the convention have been indicted by the grand jury, and many of them arrested and held to bail.

<milestone unit="sentence" n="3652" />As to whether the civil authorities can mete out ample justice to the guilty parties on both sides, I must say it is my opinion, unequivocally, that they cannot.

<milestone unit="sentence" n="3653" /><persName n="Abell,Judge,,,," id="n0035.0035.00419.04905" reg="nearbymention:Abell,E.,,," authname="abell,e."><roleName n="Judge" full="yes">Judge</roleName> <surname full="yes">Abell</surname></persName>, whose course I have closely watched for nearly a year, I now consider <num value="1">one</num> of the most dangerous men that we have here to the peace and quiet of the city.

<milestone unit="sentence" n="3654" />The leading men of the convention-King, <persName n="Cutler,,,,," id="n0035.0035.00419.04906" reg="mostcommon:Cutler,nomatch:0" authname="cutler"><surname full="yes">Cutler</surname></persName>, <persName n="Hahn,,,,," id="n0035.0035.00419.04907" reg="mostcommon:Hahn,nomatch:0" authname="hahn"><surname full="yes">Hahn</surname></persName>, and others — have been political agitators, and are bad men. I regret to say that the course of <persName n="Wells,Governor,,,," id="n0035.0035.00419.04908" reg="mostcommon:Wells,William,,,:3" authname="wells,william"><roleName n="Governor" full="yes">Governor</roleName> <surname full="yes">Wells</surname></persName> has been vacillating, and that during the late trouble he has shown very little of the man. </p> 
<p>

<milestone unit="sentence" n="3656" />Subsequently a <orgName n="Military Commission" type="commission">military commission</orgName> investigated the subject of the riot, taking a great deal of testimony.

<milestone unit="sentence" n="3657" />The commission substantially confirmed the conclusions given in my despatches, and still later there was an investigation by a select committee of the <orgName n="House of Representatives" type="government">House of Representatives</orgName>, of which the <rs>Honorables Samuel Shellabarger</rs>, of <placeName reg="Ohio, United States, North and Central America" key="tgn,7007706" authname="tgn,7007706">Ohio</placeName>, <persName n="Elliot,,H.,L.,," id="n0035.0035.00419.04910" reg="default:Elliot,H.,L.,," authname="elliot,h.,l."><foreName full="yes">H.</foreName> <foreName full="yes">L.</foreName> <surname full="yes">Elliot</surname></persName>, of <placeName reg="Massachusetts" key="tgn,7007517" authname="tgn,7007517">Massachusetts</placeName>, and <persName n="Boyer,,B.,M.,," id="n0035.0035.00419.04911" reg="default:Boyer,B.,M.,," authname="boyer,b.,m."><foreName full="yes">B.</foreName> <foreName full="yes">M.</foreName> <surname full="yes">Boyer</surname></persName>, of <placeName reg="Pennsylvania" key="tgn,7007710" authname="tgn,7007710">Pennsylvania</placeName>, were the members.

<milestone unit="sentence" n="3658" />The majority report of the committee also corroborated, in all essentials, my reports of the distressing occurrence.

<milestone unit="sentence" n="3659" />The committee likewise called attention to a violent speech made by <persName n="Johnson,Mister,,,," id="n0035.0035.00419.04912" reg="nearbymention:Johnson,Andrew,,," authname="johnson,andrew"><roleName n="Mister" full="yes">Mr.</roleName> <surname full="yes">Johnson</surname></persName> at <placeName reg="Saint Louis, Saint Louis City, Missouri" key="tgn,7014444" authname="tgn,7014444">St. Louis</placeName> in <dateStruct value="1866-09-" full="yes" authname="1866-09"><month reg="09" full="yes">September</month>, <year reg="1866" full="yes">1866</year></dateStruct>, charging the origin of the riot to Congress, and went on to say of the speech that <quote>it was an unwarranted and unjust expression of hostile feeling, without pretext or foundation in fact.</quote>

<milestone unit="sentence" n="3660" />A list of the killed and wounded was embraced in the committee's report, and among <pb id="p.420" n="420" /> other conclusions reached were the following: <quote>That the meeting of <dateStruct value="-07-30" full="yes" authname="--07-30"><month reg="07" full="yes">July</month> <day reg="30" full="yes">30</day></dateStruct> was a meeting of quiet citizens, who came together without arms and with intent peaceably to discuss questions of public concern .... There has been no occasion during our National history when a riot has occurred so destitute of justifiable cause, resulting in a massacre so inhuman and fiendlike, as that which took place at New Orleans on the <dateStruct value="-07-30" full="yes" authname="--07-30"><day reg="30" full="yes">30</day> of <month reg="07" full="yes">July</month></dateStruct> last.

<milestone unit="sentence" n="3661" />This riotous attack upon the convention, with its terrible results of massacre and murder, was not an accident.

<milestone unit="sentence" n="3662" />It was the determined purpose of the mayor of the city of <placeName reg="New Orleans, Orleans, Louisiana" key="tgn,7014214" authname="tgn,7014214">New Orleans</placeName> to break up this convention by armed force.</quote>

<milestone unit="sentence" n="3663" /></p> 
<p>The statement is also made, that <quote>He [the <rs>President</rs>] knew that <q direct="unspecified">rebels</q> and <q direct="unspecified">thugs</q> and disloyal men had controlled the election of <persName n="Monroe,Mayor,,,," id="n0035.0035.00420.04913" reg="nearbymention:Monroe,John,T.,," authname="monroe,john,t."><roleName n="Mayor" full="yes">Mayor</roleName> <surname full="yes">Monroe</surname></persName>, and that such men composed chiefly his police force.</quote>

<milestone unit="sentence" n="3664" /></p> 
<p>The committee held that no legal government existed in <placeName reg="Louisiana" key="tgn,7007256" authname="tgn,7007256">Louisiana</placeName>, and recommended the temporary establishment of a provisional government therein; the report concluding that <quote>in the meantime the safety of all Union men within the <rs>State</rs> demands that such government be formed for their protection, for the well being of the nation and the permanent peace of the <rs>Republic</rs>.</quote>

<p>The New Orleans riot agitated the whole country, and the official and other reports served to intensify and concentrate the opposition to <persName n="Johnson,President,,,," id="n0035.0035.00420.04914" reg="nearbymention:Johnson,Andrew,,," authname="johnson,andrew"><roleName n="President" full="yes">President</roleName> <surname full="yes">Johnson</surname></persName>'s policy of reconstruction, a policy resting exclusively on and inspired solely by the executive authority — for it was made plain, by his language and his acts, that he was seeking to rehabilitate the seceded States under conditions differing not a whit from those existing before the rebellion; that is to say, without the slightest constitutional provision regarding the status of the emancipated slaves, and with no assurances of protection for men who had remained loyal in the war. </p> 
<p>

<milestone unit="sentence" n="3666" />In <dateStruct value="1866-12-" full="yes" authname="1866-12"><month reg="12" full="yes">December</month>, <year reg="1866" full="yes">1866</year></dateStruct>, Congress took hold of the subject with such vigor as to promise relief from all these perplexing disorders, and, after much investigation and a great deal of debate, there resulted the so-called <quote>Reconstruction laws,</quote> which, for a clear understanding of the powers conferred on the <rs type="role" reg="military-Commander">military commanders</rs>, I deem best to append in full:

<p>

<milestone unit="sentence" n="3667" />Whereas, no legal State governments or adequate protection for life or property now exist in the rebel States of <placeName key="tgn,7007919" n="1.000 14" reg="virginia" authname="tgn,7007919">Virginia</placeName>, <placeName reg="North Carolina" key="tgn,7007709" authname="tgn,7007709">North Carolina</placeName>, <placeName reg="South Carolina" key="tgn,7007712" authname="tgn,7007712">South Carolina</placeName>, <placeName reg="Georgia" key="tgn,7007248" authname="tgn,7007248">Georgia</placeName>, <placeName reg="Mississippi" key="tgn,7007522" authname="tgn,7007522">Mississippi</placeName>, <placeName reg="Alabama" key="tgn,7002659" authname="tgn,7002659">Alabama</placeName>, <placeName reg="Louisiana" key="tgn,7007256" authname="tgn,7007256">Louisiana</placeName>, <placeName reg="Florida" key="tgn,7007240" authname="tgn,7007240">Florida</placeName>, <placeName reg="Texas" key="tgn,7007826" authname="tgn,7007826">Texas</placeName>, and <placeName reg="Arkansas" key="tgn,7016172" authname="tgn,7016172">Arkansas</placeName>; and <pb id="p.421" n="421" /> whereas, it is necessary that peace and good order should be enforced in said States until loyal and republican State governments can be legally established; therefore, <hi rend="italics">Be it enacted by the <name>Senate</name> and <orgName n="House of Representatives" type="government">House of Representatives of the <placeName reg="United States" key="tgn,7012149" authname="tgn,7012149">United States of America</placeName></orgName> in Congress assembled</hi>, That said rebel States shall he divided into military districts and made subject to the military authority of the <placeName reg="United States" key="tgn,7012149" authname="tgn,7012149">United States</placeName> as hereinafter prescribed; and for that purpose <placeName key="tgn,7007919" n="1.000 14" reg="virginia" authname="tgn,7007919">Virginia</placeName> shall constitute the <orgName n="District of North Carolina 1" type="district">first district; North Carolina</orgName> and <placeName reg="South Carolina" key="tgn,7007712" authname="tgn,7007712">South Carolina</placeName>, the <orgName n="District of Georgia, Alabama 2">second district; Georgia, Alabama</orgName>, and <placeName reg="Florida" key="tgn,7007240" authname="tgn,7007240">Florida</placeName>, the <orgName n="District of Mississippi 3" type="district">third district; Mississippi</orgName> and <placeName reg="Arkansas" key="tgn,7016172" authname="tgn,7016172">Arkansas</placeName>, the <orgName type="district" n="district 4">fourth district</orgName>; and <placeName reg="Louisiana" key="tgn,7007256" authname="tgn,7007256">Louisiana</placeName> and <placeName reg="Texas" key="tgn,7007826" authname="tgn,7007826">Texas</placeName>, the <orgName type="district" n="district 5">fifth district</orgName>. </p> 
<p>

<milestone unit="sentence" n="3668" /><rs type="role">Sec.</rs> <num value="2">2</num>. <hi rend="italics">And be it further enacted</hi>, That it shall be the duty of the <rs>President</rs> to assign to the command of each of said districts an officer of the army not below the rank of brigadier-general, and to detail a sufficient military force to enable such officer to perform his duties and enforce his authority within the district to which he is assigned. </p> 
<p>

<milestone unit="sentence" n="3669" /><rs type="role">Sec.</rs> <num value="3">3</num>. <hi rend="italics">And be it further enacted</hi>, That it shall be the duty of each officer assigned as aforesaid to protect all persons in their rights of person and property, to suppress insurrection, disorder, and violence, and to punish, or cause to be punished, all disturbers of the public peace and criminals, and to this end he may allow local civil tribunals to take jurisdiction of and to try offenders, or, when in his judgment it may be necessary for the trial of offenders, he shall have power to organize military commissions or tribunals for that purpose, and all interference, under cover of State authority, with the exercise of military authority under this act, shall be null and void. </p> 
<p>

<milestone unit="sentence" n="3670" /><rs type="role">Sec.</rs> <num value="4">4</num>. <hi rend="italics">And be it further enacted</hi>, That all persons put under military arrest by virtue of this act shall be tried without unnecessary delay, and no cruel or unjust punishment shall be inflicted; and no sentence of any <orgName n="Military Commission" type="commission">military commission</orgName> or tribunal hereby authorized affecting the life or liberty of any person, shall be executed until it is approved by the officer in command of the district; and the laws and regulations for the government of the army shall not be affected by this act, except in so far as they conflict with its provisions: <hi rend="italics">Provided</hi>, That no sentence of death, under the provisions of this act, shall be carried into effect without the approval of the <rs>President</rs>. </p> 
<p>

<milestone unit="sentence" n="3671" /><rs type="role">Sec.</rs> <num value="5">5</num>. <hi rend="italics">And be it further enacted</hi>, That when the people of any <num value="1">one</num> of said rebel States shall have formed a constitution of government in conformity with the <rs n="Constitution of the United States" type="document">Constitution of the United States</rs> in all respects, framed by a <orgName n="Delegates Convention" type="convention">convention of delegates</orgName> elected by the male citizens of said State <measure n="21years" type="date">twenty-one years</measure> old and upward, of whatever race, color, or previous condition, who have been resident in said State for <num value="1">one</num> year previous to the day of such election, except such as may be disfranchised for participation in the rebellion, or for felony at common law; and when such constitution shall provide that the elective franchise shall be enjoyed by all such persons as have the qualifications herein stated for electors of delegates; and when such constitution shall be ratified by a majority of the persons voting on the question of ratification who are qualified as electors for delegates, and when such constitution shall have been submitted to Congress for examination and approval, and Congress shall have approved the same; and <pb id="p.422" n="422" /> when said State, by a vote of its legislature elected under said constitution, shall have adopted the amendment to the <rs n="Constitution of the United States" type="document">Constitution of the United States</rs> proposed by the <num value="39" type="ordinal">Thirty-ninth</num> Congress, and known as article <num value="14">fourteen</num>; and when said article shall have become a part of the <rs n="Constitution of the United States" type="document">Constitution of the United States</rs>, said State shall be declared entitled to representation in congress, and senators and representatives shall be admitted therefrom on their taking the oath prescribed by law; and then and thereafter the preceding sections of this act shall be inoperative in said State: <hi rend="italics">Provided</hi>, That no person excluded from the privilege of holding office by said proposed amendment to the <rs n="Constitution of the United States" type="document">Constitution of the United States</rs> shall be eligible to election as a member of the convention to frame a constitution for any of said rebel States, nor shall any such person vote for members of such convention. </p> 
<p>

<milestone unit="sentence" n="3672" /><rs type="role">Sec.</rs> <num value="6">6</num>. <hi rend="italics">And be it further enacted</hi>, That until the people of said rebel States shall be by law admitted to representation in the <orgName n="United STATES Congress" type="congress">Congress of the United States</orgName>, any civil government which may exist therein shall be deemed provisional only, and in all respects subject to the paramount authority of the <placeName reg="United States" key="tgn,7012149" authname="tgn,7012149">United States</placeName> at any time to abolish, modify, control, or supersede the same; and in all elections to any office under such provisional governments all persons shall be entitled to vote, and none others, who are entitled to vote under the <orgName type="regiment" key="5Section">fifth section</orgName> of this act; and noperson shall be eligible to any office under any such provisional governments who would be disqualified from holding office under the provisions of the <num value="3" type="ordinal">third</num> article of said constitutional amendment. </p>

<head>An act supplementary to an act entitled <quote>an act to provide for the more efficient government of the rebel States,</quote> passed <dateStruct value="1867-03-2" full="yes" authname="1867-03-02"><month reg="03" full="yes">March</month> <day reg="2" full="yes">second</day>, <year reg="1867" full="yes">eighteen hundred and sixty-seven</year></dateStruct>, and to facilitate restoration.</head>

<milestone unit="sentence" n="3674" /><hi rend="italics">Be it enacted by the <name>Senate</name> and <orgName n="House of Representatives" type="government">House of Representatives of the <placeName reg="United States" key="tgn,7012149" authname="tgn,7012149">United States of America</placeName></orgName> in Congress assembled</hi>, That before the <dateStruct value="1867-09-1" full="yes" authname="1867-09-01"><day reg="1" full="yes">first</day> day of <month reg="09" full="yes">September</month>, <year full="yes">eighteen hundred and sixty-seven</year>,</dateStruct> the <rs type="role" reg="commanding-General">commanding general</rs> in each district defined by an act entitled <quote>An act to provide for the more efficient government of the rebel States,</quote> passed <dateStruct value="1867-03-2" full="yes" authname="1867-03-02"><month reg="03" full="yes">March</month> <day reg="2" full="yes">second</day>, <year reg="1867" full="yes">eighteen hundred and sixty-seven</year></dateStruct>, shall cause a registration to be made of the male citizens of the <placeName reg="United States" key="tgn,7012149" authname="tgn,7012149">United States</placeName>, <measure n="21years" type="date">twenty-one years</measure> of age and upwards, resident in each county or parish in the <rs>State</rs> or States included in his district, which registration shall include only those persons who are qualified to vote for delegates by the act aforesaid, and who shall have taken and subscribed the following oath or affirmation: <quote>I, _____ , do solemnly swear (or affirm), in the presence of the <name>Almighty</name> <name n="God" type="God">God</name>, that I am a citizen of the <rs>State</rs> of __________ ; that I have resided in said State for__ months next preceding this day, and now reside in the county of _____, or the parish of __ , in said State, (as the case may be); that I am <measure n="21years" type="date">twenty-one years</measure> old; that I have <pb id="p.423" n="423" /> not been disfranchised for participation in any rebellion or civil war against the <placeName reg="United States" key="tgn,7012149" authname="tgn,7012149">United States</placeName>, nor for felony committed against the laws of any State or of the <placeName reg="United States" key="tgn,7012149" authname="tgn,7012149">United States</placeName>; that I have never been a member of any <orgName n="State Legislature" type="legislature">State Legislature</orgName>, nor held any executive or judicial office in any State, and afterwards engaged in insurrection or rebellion against the <placeName reg="United States" key="tgn,7012149" authname="tgn,7012149">United States</placeName>, or given aid or comfort to the enemies thereof; that I have never taken an oath as a member of <orgName n="United STATES Congress" type="congress">Congress of the United States</orgName>, or as an officer of the <placeName reg="United States" key="tgn,7012149" authname="tgn,7012149">United States</placeName>, or as a member of any <orgName n="State Legislature" type="legislature">State Legislature</orgName>, or as an executive or judicial officer of any State, to support the <rs n="Constitution of the United States" type="document">Constitution of the United States</rs>, and afterwards engaged in insurrection or rebellion against the <placeName reg="United States" key="tgn,7012149" authname="tgn,7012149">United States</placeName> or given aid or comfort to the enemies thereof; that I will faithfully support the <rs>Constitution</rs> and obey the laws of the <placeName reg="United States" key="tgn,7012149" authname="tgn,7012149">United States</placeName>, and will, to the best of my ability, encourage others so to do: so help me <name n="God" type="God">God</name></quote> ; which oath or affirmation may be administered by any registering officer. </p>

<milestone unit="sentence" n="3675" /><rs type="role">Sec.</rs> <num value="2">2</num>. <hi rend="italics">And be it further enacted</hi>, That after the completion of the registration hereby provided for in any State, at such time and places therein as the <rs type="role" reg="commanding-General">commanding general</rs> shall appoint and direct, of which at least <measure n="30days" type="date">thirty days</measure> public notice shall be given, an election shall be held of delegates to a convention for the purpose of establishing a constitution and civil government for such State loyal to the <rs>Union</rs>, said convention in each State, except <placeName key="tgn,7007919" n="1.000 14" reg="virginia" authname="tgn,7007919">Virginia</placeName>, to consist of the same number of members as the most numerous branch of the <orgName n="State Legislature" type="legislature">State Legislature</orgName> of such State in the year <dateStruct value="1860" full="yes" authname="1860"><year reg="1860" full="yes">eighteen hundred and sixty</year></dateStruct>, to be apportioned among the several districts, counties, or parishes of such State by the <rs type="role" reg="commanding-General">commanding general</rs>, giving each representation in the ratio of voters registered as aforesaid as nearly as may be. The convention in <placeName key="tgn,7007919" n="1.000 14" reg="virginia" authname="tgn,7007919">Virginia</placeName> shall consist of the same number of members as represented the territory now constituting <placeName key="tgn,7007919" n="1.000 14" reg="virginia" authname="tgn,7007919">Virginia</placeName> in the most numerous branch of the <name>Legislature</name> of said State in the year <dateStruct value="1860" full="yes" authname="1860"><year reg="1860" full="yes">eighteen hundred and sixty</year></dateStruct>, to be apportioned as aforesaid. </p> 
<p>

<milestone unit="sentence" n="3676" /><rs type="role">Sec.</rs> <num value="3">3</num>. <hi rend="italics">And be it further enacted</hi>, That at said election the registered voters of each State shall vote for or against a convention to form a constitution therefor under this act. Those voting In favor of such a convention shall have written or printed on the ballots by which they vote for delegates, as aforesaid, the words <quote>For a convention,</quote> and those voting against such a convention shall have written or printed on such ballot the words <quote>Against a convention.</quote>

<milestone unit="sentence" n="3677" />The persons appointed to superintend said election, and to make return of the votes given thereat, as herein provided, shall count and make return of the votes given for and against a convention; and the <rs type="role" reg="commanding-General">commanding general</rs> to whom the same shall have been returned shall ascertain and declare the total vote in each State for and against a convention.

<milestone unit="sentence" n="3678" />If a majority of the votes given on that question shall be for a convention, then such convention shall be held as hereinafter provided; but if a majority of said votes shall be against a convention, then no such convention shall be held under this act: <hi rend="italics">Provided</hi>, That such convention shall not be held unless a majority of all such registered voters shall have voted on the question of holding such convention.

<milestone unit="sentence" n="3679" /><pb id="p.424" n="424" /> </p> 
<p><rs type="role">Sec.</rs> <num value="4">4</num>. <hi rend="italics">And be it further enacted</hi> That the <rs type="role" reg="commanding-General">commanding general</rs> of each district shall appoint as many boards of registration as may be necessary, consisting of <num value="3">three</num> loyal officers or persons, to make and complete the registration, superintend the election, and make return to him of the votes, list of voters, and of the persons elected as delegates by a plurality of the votes cast at said election; and upon receiving said returns he shall open the same, ascertain the persons elected as delegates, according to the returns of the officers who conducted said election, and make proclamation thereof; and if a majority of the votes given on that question shall be for a convention, the <rs type="role" reg="commanding-General">commanding general</rs>, within <measure n="60days" type="date">sixty days</measure> from the date of election, shall notify the delegates to assemble in convention, at a time and place to be mentioned in the notification, and said convention, when organized, shall proceed to frame a constitution and civil government according to the provisions of this act, and the act to which it is supplementary; and when the same shall have been so framed, said constitution shall be submitted by the convention for ratification to the persons registered under the provisions of this act at an election to be conducted by the officers or persons appointed or to be appointed by the <rs type="role" reg="commanding-General">commanding general</rs>, as hereinbefore provided, and to be held after the expiration of <measure n="30days" type="date">thirty days</measure> from the date of notice thereof, to be given by said convention; and the returns thereof shall be made to the <rs type="role" reg="commanding-General">commanding general</rs> of the district. </p> 
<p>

<milestone unit="sentence" n="3680" /><rs type="role">Sec.</rs> <num value="5">5</num>. <hi rend="italics">And be it further enacted</hi>, That if, according to said returns, the constitution shall be ratified by a majority of the votes of the registered electors qualified as herein specified, cast at said election, at least <num value="0.5">one-half</num> of all the registered voters voting upon the question of such ratification, the president of the convention shall transmit a copy of the same, duly certified, to the <rs>President</rs> of the <placeName reg="United States" key="tgn,7012149" authname="tgn,7012149">United States</placeName>, who shall forthwith transmit the same to Congress, if then in session, and if not in session, then immediately upon its next assembling; and if it shall moreover appear to Congress that the election was <num value="1">one</num> at which all the registered and qualified electors in the <rs>State</rs> had an opportunity to vote freely, and without restraint, fear, or the influence of fraud, and if the <rs>Congress</rs> shall be satisfied that such constitution meets the approval of a majority of all the qualified electors in the <rs>State</rs>, and if the said constitution shall be declared by Congress to be in conformity with the provisions of the act to which this is supplementary, and the other provisions of said act shall have been compiled with, and the said constitution shall be approved by Congress, the <rs>State</rs> shall be declared entitled to representation, and senators and representatives shall be admitted therefrom as therein provided. </p>

<milestone unit="sentence" n="3681" /><rs type="role">Sec.</rs> <num value="6">6</num>. <hi rend="italics">And be it further enacted</hi>, That all elections in the <name>States</name> mentioned in the said <quote>Act to provide for the more efficient government of the rebel States</quote> shall, during the operation of said act, be by ballot; and all officers making the said registration of voters and conducting said elections, shall, before entering upon the discharge of their duties, take and subscribe the oath prescribed by the act approved <dateStruct value="1862-07-2" full="yes" authname="1862-07-02"><month reg="07" full="yes">July</month> <day reg="2" full="yes">second</day>, <year reg="1862" full="yes">eighteen hundred and sixty-two</year></dateStruct>, entitled <quote>An act to prescribe an oath of office</quote> : <hi rend="italics">Provided</hi>, That if any person shall knowingly and falsely take and subscribe any oath in this act prescribed, such person so offending <pb id="p.425" n="425" /> and being thereof duly convicted, shall be subject to the pains, penalties, and disabilities which by law are provided for the punishment of the crime of wilful and corrupt perjury. </p> 
<p>

<milestone unit="sentence" n="3682" /><rs type="role">Sec.</rs> <num value="7">7</num>. <hi rend="italics">And be it further enacted</hi>, That all expenses incurred by the several commanding generals, or by virtue of any orders issued, or appointments made, by them, under or by virtue of this act, shall be paid out of any moneys in the treasury not otherwise appropriated. </p>

<milestone unit="sentence" n="3683" /><rs type="role">Sec.</rs> <num value="8">8</num>. <hi rend="italics">And be it further enacted</hi>, That the convention for each State shall prescribe the fees, salary, and compensation to be paid to all delegates and other officers and agents herein authorized or necessary to carry into effect the purposes of this act not herein otherwise provided for, and shall provide for the levy and collection of such taxes on the property in such State as may be necessary to pay the same. </p> 
<p>

<milestone unit="sentence" n="3684" /><rs type="role">Sec.</rs> <num value="9">9</num>. <hi rend="italics">And be it further enacted</hi>, That the word <quote>article,</quote> in the <orgName type="regiment" key="6Section">sixth section</orgName> of the act to which this is supplementary, shall be construed to mean <quote>section.</quote>
