The proof did not sustain the allegation made against the parties, and they were discharged. The witnesses in the case of Jos. Kregar, charged with being the person who shot and killed Michael Horan, otherwise Rocketts Mike, at a place near Richmond kept by Carter & Roache, not being present when the case was called, the prisoner was sent to jail until they could be summoned by the police.
