rigades, to-wit: Paniel's, Iverson's and Ramseur's North Carolina brigades, Doles's Georgia brigade, and Rodes's (old) Alabama brigade, commanded by Col O'Neill. Carter's battalion of artillery was attached to this command. Rodes came into the engagement on the flank of the enemy, who were confronting A P Bill, and occupied the or more behind Iverson's right, to protect that flank. Ramseur was in reserve, and the 5th Alabama was left to hold the gap between O'Neill and Doles. After Carter's battalion of artillery had been engaged for some half an hour with admirable effect, the enemy were observed to be moving rapidly from Hill's front to that of R nobly and suffered severely, especially Daniel's North Carolina brigade. These latter were new men, yet they behaved with unsurpassed gallantry, losing 900 men. Sentence was suspended until a second indictment against the accused, for stealing various articles from Philip M. Tabb, shall have been tried and the verdict of the jury ascertained. The trial of Charles Driggers and James Small, of stealing a lot of car springs from the Petersburg Railroad, resulted in the conviction of Small of petty larceny. The punishment imposed was merely nominal, counsel stating that Small would be mustered into some company of the Confederate service, if punishment was remitted. A nolle prosequi was entered on the indictment against Charles Driggers in consideration of his youth. The jury in the case of Julius C. Waltaman, indicted for stealing two cows from James M. Carter, not being able to agree, were discharged, and a new venire ordered to be summoned to attend this morning for the trial of the case.
