Parker returned with the body of Fariss that be had been enlisted in the service, and while in the An amendment being insisted on by Mr. Gilmer, counsel for Fariss, so as to show when the offence was charged and the court that the charge had been preferred since the discharge of Fariss under a habeas corpus by the Circuit Court of Richmond. T until it was reversed on an appeal regularly taken. That Fariss had a properly-attested copy of this order of Court in hisurt which would not be tolerated. He should now discharge Fariss, and at the next regular term of this Court cause the propand orders of this Court must be obeyed. The discharge of Fariss related back to the date of his enlistment; and having beet. Parker must pay the costs of this last application, and Fariss stand finally and rightfully discharged.
