The end of the war found Captain Harby in command of the harbor of Galveston, in which city he continued to reside up to the time of his death, which occurred on December 3, 1870, having neither asked nor received a pardon from the government which he had served for forty-eight years. Captain Harby married, in 1842, Miss Leonora R., daughter of Judge L. S. DeLyon, of Savannah, Ga. He left three children: Mrs. J. W. Frank, of Galveston, Tex., since deceased; Henry J. Harby, of Houston, Tex., a member of Company C, Twenty-sixth Texas cavalry (DeBray's regiment); and J. D. Harby, now of Charleston, a member of the Eighth company, Texas light artillery, Fountaine's battalion, C. S. A. Major Frank Bernard Hardin, professor of chemistry in Clemson college, S.
