Sent on for felony. --Lorenzo W. Frayser, a young man of about twenty summers, was examined yesterday before a called. Court of Magistrates, on the charge of breaking into a lodging room in the law office of John N. Davis, and stealing therefrom $30 worth of wearing apparel and other articles. Frayser, it seems, knew that two of the sons of Mr. Davis slept in the room during the week, so that they could attend school in the city, and that they went to their father's, in the county, every Friday afternoon, and remained there till Monday morning. In their absence the room was forcibly entered and robbed, and the very next night a portion of the stolen articles were found upon the prisoner's person. After a patient hearing of the case, the accused was remanded for felony before Judge Lyons' Court. He was offered bail, but finding no one to join him in the bond, was remanded to prison.
The Grand Jury of Judge Lyons' court will meet on Friday next, pursuant to adjournment. The following cases will be sent to them for their action: Mullen and Summers, two young men, for shooting at each other in a public street; John Mescoe, for receiving sugar stolen from Davenport & Co, knowing the same to have been stolen. It is also thought by some that Charles H. Jefford, charged with stealing $30 in money, will waive an examination before a called Court of Justices, and have his cause sent to the Grand Jury for immediate action. Witnesses are reminded to be present at the time appointed, if they wish to escape a fine.
Convicted of felony. --Henry B. Hernandez, indicted for feloniously breaking into a servant's house and stealing therefrom $60 worth of furniture, was arraigned before Judge Lyons yesterday for trial, and plead not guilty. The witnesses so clearly fixed the charge upon the accused, however, that the jury found him guilty, and ascertained his punishment at three years in the penitentiary. Hernandez has already served one term in the State's prison, and, as a consequence, will get five additional years added to his present sentence because of that fact.
Assaulting a Woman. --Charles Colgate, indicted for feloniously assaulting and beating Elizabeth Tally, with intention to maim, disable and kill her, was put on trial before Judge Lyons yesterday, and plead not guilty. The examination of the witnesses commenced at a late hour, and as a consequence, was not concluded at the time we left Court.
