Judon Lyons' Court.
--James Smith, sent on for stealing two watches, a pistol, and seventy-three dollars in money from John T. Townsend, was convicted of the offence and sentenced to four years in the penitentiary.
John F. Fitzgerald, indicted for obtaining one thousand five hundred dollars under false pretences from Fisher & Bailey, was pronounced guilty by the jury, and his punishment assessed at three years and eight months in the penitentiary.
Upon the rendition of the verdict, General Humphrey Marshall, counsel for the accused, motioned to set aside the finding of the jury; whereupon the court took a recess till four o'clock, at which hour the Judge assembled to hear the points of argument upon which the motion was based.
