Important decision. --Dr. A. E. Peticolas, the reputed physician for Mr. John M. Daniel in a duel recently fought between himself and Assistant Secretary of the Treasury Elmore, was discharged yesterday by the Court of Appeals from all obligation to give evidence relative to the matter. It will be recollected by our readers that soon after the difficulty occurred the Examining Court of Henrico county insisted upon Dr. Peticolas testifying in the matter, and, upon his refusal to do so, orDr. Peticolas testifying in the matter, and, upon his refusal to do so, ordered his commitment to jail. Subsequently, the case was taken before Judge Meredith on a question of bail, when that functionary decided adversely to the opinion of the county justices, and admitted him to bail. The decision of the Court of Appeals, as we are informed, releases all persons from testifying in the matter of duels where it is alleged their evidence might implicate themselves and thereby subject them to criminal prosecution.
