ischarged from active duty, as he was over the conscript age at the time of enrollment, and to be put into the reserves. After argument by counsel, the Court retained its decision until this morning. Hon. B. B. Douglas, of the Virginia Senate, appeared for affiant; B. R. Welford, Jr., for Government. Peyton Johnston was discharged from the custody of Colonel J. B. Danforth, under a writ of habeas corpus, in consequence of being over the age of fifty years. The case of James Kennedy, who applies for a discharge from the same regiment on the same grounds, was continued until Monday. In the case of William Wingfield, of Hanover county, a bonded farmer, who was among those whose details were revoked, and he now applies for a discharge under his bond: after hearing the evidence and arguments of counsel, the Court reserved its decision until Monday next. Hon. James Lyons and — Winn, of Hanover, represented the affiant; Mr. B. R. Welford, Jr., appeared for the Government.
