Marion, made an explanation of some portion of his previous remarks on taxation, the same having been misunderstood. Committee of the Whole. The hour of half-past 10 having arrived, the Convention went into Committee of the Whole. The Chairman (Mr. Southall) being absent, Mr. Price, of Greenbrier, was called to the chair. The Chairman stated that the substitute of the gentleman from Harrison having been voted down, the only subject before the Committee was the report of the majority of the Committee on Federal Relations. Mr. Anbler of Louisa, said that Mr. Harvin had indicated a desire to offer an amendment. He was not present, and no one here was authorized to act for him. The Chairman, who had recognized Mr. Anbler, said that Mr. Nelson, of Clarke, was entitled to the floor. Mr. Anbler took an appeal from this decision, and the Chair was sustained by the Committee. Mr. Nelson then yielded the floor to Mr. Preston, of Montgomery, who proceeded
gain called, the vote resulted — yeas 12, nays 56--no quorum voting. The fact was reported, (Mr. Sheffey in the Chair,) and Mr. Jackson, of Wood, moved a call of the House. Mr. Macfarland moved an adjournment, and it was decided that this motion took precedence over every other question. Mr. Jackson demanded the yeas and nays upon the motion to adjourn. The roll was called and the vote resulted — yeas 26, nays 54. So the Convention refused to adjourn. Mr. Early.--Mr. Chairman, I offer a resolution-- Mr. Harvie.--I rise to a point of order.--The rules require a member to rise from his seat and address the Chair. The gentleman was standing in the aisle, and did not rise from his seat. [Laughter.] The Chairman said he had recognized the gentleman while he was standing.
