The Court sent the prisoner on to be tried before Judge Lyons, and refused to admit him to bail. Henry P. Elston was examined for having on the 29th day of November, feloniously broke into the store-house of Samuel D. Hicks, and violently assaulted said Hicks with intent to rob him. Elston having proved an alibi by some half dozen or more witnesses, waSmith was examined for having, on the 27th day of November, stolen from George R. Howard a cloth cost worth $25.
