C. S. District Court. --In the case of M. Kracker, indicted for perjury, the counsel for the accused demurred to the indictment, which demurrer was partly argued by F. L. Smith, who represents the Government in the absence of the Attorney. George W. Johnson, claiming an exemption from the Confederate service upon the ground that he is a regularly commissioned Lieutenant in the 74th regiment of Virginia Militia, was ordered to be discharged from the custody of Sergeant James B. McCaw. The case of Josiah Blackburn, wherein the validity of the act placing in the service a person who has furnished a substitute will be tested, was set for hearing for to-morrow.
