Proceedings in the Courts.
Mayor's Court, October 23.
--Ellen Norman, free, was ordered to be whipped for living in the city with Henrico papers, contrary to law.
The case of Baily Spurrell, for taking two blankets belonging to Maj. Wm. Allan, worth $50, was continued — the witness in the case not appearing when called.
Mary J Smith was ordered to be whipped for stealing $15 from Tabby Clayton.
Both parties are colored.
Charles, slave of Col. Ayres, was sent on to be tried before the Hustings Court on the 2d Monday in November, on the charge of stealing a box of clothing from R. L. Steward, at the American Hotel.
His master gave bail for his appearance.
Mary Garrity was required to give $150 security for assaulting and beating John Coyle and his wife, and child.
Failing, she was committed.
Elias Vanderlip and Owen Riley underwent a lengthy examination on the charge of stealing $107 from Lindsey Smith, a paroled C. S. soldier, on Saturday evening, at the upper end of Grace street. The evidence of the soldier being positive as to the loss, and by whom inflicted, and defendants' witnesses being equally prompt in proving an alibi, the case was continued until this morning for further examination.
Mary E. Sawyer, alias Carrington, formerly of Washington, was committed in default of surety for associating with David, slave of Mary Smith, and the latter was ordered 30 stripes, and sent to jail for going at large.
Thomas Dobson, a lad was arraigned on the charge of stealing, on Thursday last, a horse worth $200, belonging to Capt. Julius H. Gantt--Michael Burns, a returned soldier from Fort Delaware, was implicated in the affair, and was introduced to the Court as Dobson's aider and abetter.
The evidence was pretty conclusive against Dobson, who was committed to appear before a called Court on the 27th of October. There being some conflict in the testimony against Burns, his case was continued until this morning.
Mrs. Ann Riley, rise Dobson, who did some pretty tall swearing on behalf of her son Tommy, was committed until the 10th of November, to await the action of a grand jury on the charge of perjury.
James McCabe, alias Johnson, was arraigned as the companion of Daniel Broderick and others in the murder of Patrick Kelley and William Downes, at a house of ill repute on 17th street, on the 9th of last May. Two females, who have been detained in jail for six months as witnesser, were brought into Court to testify in the case, but the examination was postponed until to day.
James, slave of James Dorning, was ordered to be punished on the complaint of Michael Murray, who alleged that Jim stole $50 from him on Sunday, on Main street, while he was getting a drink of water from one of the city pumps below the Old Market-House.
Hustings Court--Hon. Wm. H Lyons Judge--Monday,Oct. 20th, 1862.--The will of the late Wm. Brent was admitted to record, and Mrs. Caroline Brent qualified as administratrix on the estate.
The case of Charles Toothaker, charged with stealing a carpet-bag, containing various articles of less value than twenty dollars, from C. S. William son, at the Columbian Hotel, on the night of the 27th of May last, was called up, and in the absence of his counsel the accused asked a continuance of the case, but the Court refused the request, the Judge assigning as a reason that if he were to continue cases merely on the plea of the absence of counsel, it would seriously retard the proceedings of the Court, and increase the docket, which was unusually large, and augmenting daily.
If counsel were not present when cases were called prisoners would have to engage others.
The accused was then tried for the offence, Daniel Ratcliffe appearing in behalf of the accused, and Littleton Tazewell for the Commonwealth.
Upon hearing the evidence in the case the jury retired, and after an absence of five minutes, brought in a verdict of guilty of petty larceny.
The Judge sentenced Toothaker to six months confinement in the city jail.
Timothy Reardan, charged with stealing a trunk from Charles Hanford at the American Hotel, was found guilty by the jury, and the Judge sentenced him to three years confinement in the penitentiary.
Veniremen and witnesses will save themselves much trouble and unnecessary expense, and facilitate the proceedings of the Court, by being punctured in their attendance.
Several gentlemen had rules issued against them for non-attendance yesterday.
Confederate State District Court--Hon. Jas. D. Halyburton, Judge--Monday, October 20, 1862.--But little business was transacted in this Course to day, further than swearing in the jury in the case of A. B. Martin, charged with purloining letters from the Richmond Post Office.
Case adjourned over until this morning.
Called Court.--A called Court of Magistrates convened yesterday in the City Hall--Recorder Caskie presiding — to examine John C. Conner, charged with robbing Wm. Linsden of $260, at his boarding-house, last Sunday week.
The examination resulted in Conner being sent on for final trial to Judge Lyons's Court.
