Mayor's Court, Friday, January 2d.
--Fowlar R. Smith, Robert E. Buzlett, and Samuel Atkins, were examined for assaulting Charles E. S. Stuart on Tuesday last, on 11th street. Stuart testified that the assault occurred after his business in the Post Office Department had concluded, and when he was standing near the corner of 11th and Main streets, and was made by Smith, with a cane of whip.
He struck Smith before he could bring his uplifted weapon down.
The latter then drew a pistol, which he seized and held on to till Captain Alexander, coming up, carried Smith off. Witness said he had proof that Hazlett told the spectator to make room and let them fight it out, also, that Atkins had remarked, "we have whipped Stuart." The provocation which Smith received was, according to the testimony, that he had been called a disgraced officer by Stuart, who would not retract the expression when called on to do so by one of Smith's friends.
The Mayor said the law had been violated by the parties making the assault, and he should require Smith and Hazlett each to give ball in $100 to keep the peace.
Atkins was discharged.
The parties gave the required ball.
