It was argued in the progress of the case that the defendant was an alien enemy on and after the 21st of May, 1851, and that his citizenship in New York continued until September, when he removed from that State, and that no change of citizenship after the commencement of hostilities between the Confederate and United States could protect the property of an alien from the sequestration act. The decision of the Judge in Elker's favor is based upon the fact that he had closed his business in New York before the commencement of hostilities, and that his removal from the North was effected as soon as he could do so after closing his business. In view of these facts and of the present loyal of the party, the Court dicided that the property was not liable to sequestration. District Attorney Aylett stated that he would take the matter of appeal under consideration until Monday, and on that any would announces whether he would appeal from the decision of the Court.
