Application for discharge. --John H. Duke, a civil prisoner at present confined in the county jail, has applied to Judge Meredith to be heard on habeas corpus, so that he may be discharged from prison on the ground of illegal detention. The Judge granted the writ, and the case will be heard on its merits at eleven o'clock to-day. Duke alleges that he is a true and loyal son of Virginia; that living in Maryland he had ventured to Martinsburg, where his parents reside, for the purpose of visiting them, and that he was there arrested without having done any act which would render him liable to the suspicion of being inimical to Southern rights. Messrs. Nance & Williams are his lawyers.
