Magistrates. --In Charlottesville, Virginia, last week, on a writ of habeas corpus in the case of several justices of the peace where the Governor had refused to certify in favor of the parties, who were under forty-five years of age, Judge Field discharged the petitioners from the custody of the military.--He remarked that a justice was a State officer, and a part of the State; that the Confederate Government was merely the agent of the States, and could not assail the State organization; that the act of the Legislature in the premises was not necessary to bring him to his judgment in the case; that, independent of it, he would have decided in the same way. He said the act was only persuasive.
