Application Refused.
--A few days ago we noticed the arrest and commitment to Castle Thunder, of one Dr. A L Wiley, charged with being the guide of Averill in his late raid in Roanoke and adjoining counties of this State.
Since his confinement, Wiley has applied to Judge Lyons for a discharge from prison under writ of habeas corpus, setting forth in his petition that no charges had been preferred against him, nor had he been informed on what ground he was held in durance vile.
Upon an investigation of the matter the evidence did not seem to be of such a character as would justify his retention in custody, and Judge Lyons therefore notified the authorities that he should either order his release or turn him over to the C. S. Commissioner.
On learning these facts an order was issued by the Secretary of War recommitting Wiley to the custody of Capt Richardson, commandant at Castle Thunder, under authority of the late act passed by Congress authorizing a suspension of the writ of
