Refusing to aid the officers.
--Two men named
Patrick McNeil and
Patrick Murphy were before the
Mayor on Saturday for refusing, when summoned, to assist
Messrs. Newman and
Wasserman, two of the Watch, while attempting the arrest of one Samuel Fury.
Instead of obeying the request of the officers, the parties resisted them.
They were required to give security to appear before the Hustings Court to answer the charge of misdemeanor.--The law expressly provides, under penalty, that the citizen shall assist the lawfully constituted authorities in the execution of the law whenever it may be interfered with, or the execution thereof is resisted by force, and aid is thereby rendered necessary for its due enforcement.
Some men indulge the foolish notion that they exhibit manliness in giving aid and comfort to the malefactors whom the bailiffs may be engaged in laying by the heels, but it is a fallacy that a thorough acquaintance with the requirements of the law and the obligations resting on all good citizens will readily dissipate.
