Sent to the penitentiary. --Two cases were tried in Judge Lyons's Court yesterday, both of which resulted in the conviction of the accused. We give their names below: Daniel Whalan, arraigned on the charge of obtaining $500 under false pretences from David Parr, was tried, found guilty, and sentenced to the penitentiary for three years. Witnesses were examined in the case against Jeremiah Tibbetts, charged with breaking open the store house of Smith, Lipscomb & Co., and stealing therefrom $40 in Confederate money. At the conclusion of the evidence, the case was placed in the hands of the jury, who, after a short retirement, returned with a verdict of guilty, and assessed the prisoner's punishment at five years in the penitentiary.
