No Theft.

--John W. Rudd, a soldier, arrested on charge of stealing a horse and buggy from Alois Rix, was examined before the Mayor yesterday. The evidence showed that Rudd, while on a bender, took possession of the horse and buggy, without knowing what he was doing, and dashed about the streets like a madman. There being nothing to show that the prisoner designed to appropriate the horse and vehicle to his own use, he was discharged of the felony, but held to bail for his future good behavior.
