Dismissed.

--A while man, named Philip Whitlock, lodged a complaint before the Mayor yesterday morning against Robert Lanier for an assault upon his person. The difficulty arose about smoking a cigar in the auctioneering department of Laniers, Tolleson & Catlett's establishment, on Pearl street. Whitlock refusing to extinguish his cheroot, after repeated requests from Mr. Lanier to do so, that gentleman proceeded to eject him by force from the auction room. Blows passed between them, and W. took out a warrant against Mr. Lanier, on the ground that he was afraid of further personal violence at his hands. Several witnesses were examined, and the Mayor, in view of the light testimony against the accused, dismissed the charge.
