A.a being over the day, i. e. as law-term, default caused by non-observance of the latest term for payment, μελλούσης μοι ἤδη ἐξήκειν τῆς . the term of my borrowing (my stay of execution) being about to expire, D.47.49; ἀναβάλλεσθαι τὴν . defer it, ib.50:—hence,
2. forfeiture of recognizances, distress, εἰληφότες τῇ ὑπερημερίᾳ having seized it by virtue of this right, Id.33.6; “κατὰ τὴν .Id.30.27; also, the amount so forfeited,ὑπερημερίαν πρᾶξαιThphr.Char.10.10; and, a document declaring such forfeiture, τᾶν ὑπερα_μεριάων (Boeot. gen. pl.) τᾶν ἰωσάων (i. e. οὐσῶν)“ κὰτ τᾶς πόλιοςIG7.3172.115 (Orchom., iii B.
