Even the infinitive with the article occasionally takes ἄν, as in ANT. v. 8, τοῦτο ὑμᾶς διδάξω, οὐ τῷ φεύγειν ἂν τὸ πλῆθος τὸ ὑμέτερον, this I will teach you, not because I would avoid your people. In SOPH. Ant. 236,τῆς ἐλπίδος τὸ μὴ παθεῖν ἂν ἄλλο” , the hope that I could not suffer anything else, the construction is practically that of indirect discourse (794).
