Important Decision.

--Augustus Nosck and Henry Benger were before Judge Halyburton yesterday on writs of habeas corpus. The parties are foreigners by birth, but have married in the South. They applied for passports to cross the lines, but being refused, attempted to run the blockade and were captured. On being sent to the conscript camp they were put in the 8th Va., regiment. The Judge decided that, as they left their families here, and admitted their intention to return, they were domiciled, and therefore subject to military duty. He therefore ordered them to be returned to their companies.
