EMPTI, ET VE´NDITI A´CTIO. The seller has an actio venditi, and the buyer an actio empti, to recover damages for breach of the duties imposed by the contract of sale upon the other party. Both are actiones directae, and belong to the class of remedies known as bonae fidei judicia. Gaius, 4.62 ; Inst. 4.6, 28.)
